1. Acceptance of Terms

School Path is a service operated by PriceSenz LLC ("PriceSenz," "School Path," "we," "us," or "our"). These Terms of Service govern your access to and use of the School Path website, platform, tools, and related services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, please do not use the Service.

We may modify these Terms from time to time. Your continued use of the Service after changes are posted means you accept the updated Terms.

2. Description of Service

School Path provides a platform to help families discover, compare, and connect with schools, educational providers, and related resources.

The Service may include:

• School search and comparison

• Preference-based school matching

• School profiles and educational resources

• TEFA / ESA-related information

• Application deadline and school visit reminders

• Personalized recommendations

• Connections to schools, vendors, consultants, or community partners

School Path is not a government agency, school, admissions authority, ESA / TEFA administrator, or financial aid decision-maker.

Any eligibility information, school match, recommendation, or resource provided through the Service is informational only and should be verified directly with the applicable school, provider, program administrator, or authorized entity.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information

• Keep your login information secure

• Notify us immediately of any unauthorized access

• Be responsible for activity under your account

We may suspend or terminate accounts that violate these Terms or misuse the Service.

4. Parent / Guardian and Adult User Requirement

The Service is intended for parents, guardians, and adult users age 18 or older.

School Path is not directed to children. Children should not create accounts or provide personal information through the Service.

By creating an account, you confirm that you are a parent, guardian, or adult user.

5. TEFA / ESA and Program Information

School Path may provide information related to the Texas Education Freedom Account program, Education Savings Accounts, school choice programs, or related educational funding options.

This information is for general informational purposes only.

School Path does not:

• Make official eligibility decisions

• Guarantee TEFA / ESA approval

• Guarantee funding

• Submit official government determinations

• Control program rules, timelines, payments, or approvals

Final eligibility, funding, and program determinations are made by the applicable Texas program administrator, state authorities, and/or their authorized implementation partners.

Program rules, deadlines, eligibility criteria, and funding availability may change. Families should verify all program details directly with official sources.

6. School Information, Recommendations, and Data Quality

School Path uses available data and parent-provided preferences to support school discovery and comparison.

School Path makes reasonable efforts to maintain useful, current, and accurate school and provider information; however, school data is collected from multiple public, third-party, school-provided, and platform-generated sources and may change without notice. We cannot guarantee that all information is complete, current, accurate, or applicable to a family's specific circumstances. Families should verify all material details directly with the applicable school, provider, or program administrator before making decisions.

School Path does not guarantee:

• Admission or enrollment

• Seat availability

• Tuition accuracy

• TEFA / ESA participation

• Transportation availability

• Special education or learning support availability

• School quality

• School safety

• Student outcomes

• Provider performance

• Accuracy of all school profile data

Families should verify all important details directly with schools and providers before making decisions.

School matches and recommendations are intended to support family decision-making. They are not a guarantee that a school is the right fit for every child or family.

7. Special Learning Needs and Sensitive Information

Families may choose to provide information about a child's learning needs, accommodations, IEP / 504 status, disability-related preferences, therapy needs, or other support needs.

School Path uses this information to help support school discovery, matching, and related parent guidance.

School Path will not share parent contact information or child-specific sensitive preferences with a school or provider unless the parent requests follow-up, submits an inquiry, schedules a tour, asks to connect, or otherwise chooses to share that information.

Families should not submit information they do not want considered as part of the school discovery or matching process.

8. Marketplace and Referral Fee Disclosure

School Path may receive fees from schools, educational providers, vendors, consultants, or community partners when families connect, enroll, purchase services, or otherwise engage through the platform.

These fees help support the operation of the platform.

Unless expressly stated, paid relationships do not guarantee admission, placement, ranking, or recommendation.

School Path aims to help families compare options clearly, but families should independently evaluate schools and providers before making decisions.

9. Third-Party Schools, Providers, and Links

Schools, vendors, consultants, service providers, TEFA / ESA resources, community partners, and external websites are independent third parties.

School Path is not responsible for third-party:

• Admissions decisions

• Services

• Pricing

• Availability

• Communications

• Representations

• Performance

• Website content

• Payment or enrollment processes

Any relationship between a family and a school, vendor, provider, or third-party service is between those parties.

10. Privacy and Data Protection

Your privacy is important to us. Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that School Path may collect and use information as described in the Privacy Policy. Our use of analytics, cookies, and similar technologies is also described in our Privacy Policy.

Use of the Service does not automatically opt you into marketing communications. Marketing or reminder emails are governed by your communication preferences and may be unsubscribed from at any time.

Text / SMS reminders, if offered, require separate consent.

11. User Content

You retain ownership of information, preferences, notes, documents, messages, or other content you submit through the Service.

By submitting content, you grant School Path a limited license to:

• Store and process the content

• Use the content to provide the Service

• Generate recommendations or matches

• Improve the Service using aggregated or de-identified information

• Communicate with you about your use of the Service

You represent that you have the right to submit the information you provide.

You agree not to submit false, misleading, unlawful, or unauthorized information.

12. Aggregated Marketplace Insights

School Path may use aggregated or de-identified data to improve the Service and provide marketplace insights.

For example, School Path may share aggregated information with schools or providers such as search volume, profile views, general parent preference trends, or broad demand signals.

School Path will not share personally identifying parent or child information with schools or providers unless the parent chooses to connect with that school or provider.

13. Prohibited Conduct

You agree not to:

• Provide false or misleading information

• Violate applicable laws or regulations

• Interfere with the operation of the Service

• Attempt unauthorized access to our systems

• Misuse the Service for fraudulent purposes

• Reverse engineer, scrape, copy, or modify the Service without permission

• Upload harmful code or content

• Use the Service to harass, mislead, or harm others

14. Intellectual Property

The Service, including its design, software, content, branding, workflows, matching logic, school profile structure, data organization, and original materials, is owned by PriceSenz LLC or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws.

"School Path" is used as the brand and product name for the Service operated by PriceSenz LLC. Nothing in these Terms grants users any ownership rights in the Service, School Path branding, software, content, or underlying technology.

You may not use, copy, reproduce, distribute, modify, scrape, reverse engineer, or create derivative works from the Service without our written permission, except as allowed through normal use of the Service.

User-submitted content remains subject to Section 11.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

School Path does not warrant that:

• The Service will be uninterrupted or error-free

• Information will always be accurate, complete, or current

• Recommendations will meet every family's needs

• Schools or providers will respond, accept, enroll, or serve a family

• Errors will be corrected immediately

• The Service will be free from viruses or harmful components

You use the Service at your own discretion and risk.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOOL PATH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOOL PATH'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ACCESS THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless School Path, its owners, employees, contractors, partners, and affiliates from any claims, damages, losses, liabilities, or expenses, including reasonable legal fees, arising from:

• Your use of the Service

• Your violation of these Terms

• Your violation of any law or third-party right

• Information or content you submit through the Service

• Your interactions with schools, vendors, providers, or third parties

18. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service.

You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute-related provisions.

19. Service Modifications

We may modify, suspend, or discontinue any part of the Service at any time.

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and each party consents to the personal jurisdiction of those courts.

Nothing in this section limits any consumer rights or remedies that cannot be waived under applicable law.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and School Path regarding the Service.
